
TERMS AND CONDITIONS

1. DEFINITIONS
1.1 "Company" means The Pureloft Sdn. Bhd., its successors and assigns or any person acting on behalf of and with the authority of The Pureloft Sdn. Bhd.
1.2 "Guest" means the person/s or entity renting the Property as specified in any agreement with the Company.
1.3 "Property" means the premises provided by the Company to the Guest for temporary accommodation.
1.4 "Rental Period" means the period during which the Guest is entitled to occupy the Property.
2. ACCEPTANCE
2.1 The Guest is deemed to have accepted these Terms and Conditions when signing a Booking Agreement or making payment for accommodation.
2.2 Any instructions received by the Company from the Guest for the supply of services shall constitute acceptance of these Terms and Conditions.
3. BOOKING AND PAYMENT
3.1 The total rental fee is payable as specified in the Booking Agreement.
3.2 A security deposit of MYR 200 for stays less than 30 days and an enhanced security deposit of MYR 1,000 for stays more than 30 days are required. By placing the deposit, Guest acknowledges having read, understood, and agreed to these Terms and Conditions. The security deposit will be refunded within seven (7) business days after check-out, subject to inspection of the Property and deduction of any applicable charges.
3.3 All payments must be made in Malaysian Ringgit (MYR).
4. CANCELLATION POLICY
4.1 No cancellation is permitted during the tenancy period. Cancellations will result in the forfeiture of deposit.
4.2 Booking amendments are subject to availability and at the discretion of the Company.
5. CHECK-IN AND CHECK-OUT
5.1 Check-in and check-out times will be specified in the Booking Agreement.
5.2 Early check-in or late check-out may be requested but is subject to availability and additional charges.
6. GUEST OBLIGATIONS
6.1 The Guest agrees not to exceed the maximum occupancy for the Property.
6.2 The Guest shall:
a) Keep the Property and all furniture, fixtures, fittings, and equipment in good condition;
b) Report any damage or defects to the Company as soon as they become apparent;
c) Allow the Company or its representatives access to the Property at reasonable times for inspection or repairs;
d) Not sublet the Property or any part thereof;
e) Not use the Property for any illegal or immoral purposes;
f) Comply with all applicable laws, rules, and regulations during their stay;
g) Not create noise or disturbance that may cause annoyance to neighbors;
h) Secure the Property when leaving it unattended.
7. CLEANING AND MAINTENANCE
7.1 The Property will be provided in a clean and tidy condition.
7.2 Additional cleaning services are available upon request for an additional fee of MYR 90.
7.3 A monthly complimentary sheet change is provided when requested.
7.4 The Guest is responsible for regular cleaning during the Rental Period.
8. SMOKING AND PETS
8.1 Smoking is strictly prohibited inside the Property. Guests may use the balcony for smoking but must ensure no smell enters the unit.
8.2 Should the presence of smoking paraphernalia or smoke smell be found in the unit, a cleaning cost of MYR 1,500 will be levied.
8.3 No pets are allowed without prior written approval and payment of applicable pet fees.
9. UTILITIES
9.1 Water and Electricity usage will be subject to a fair usage cap of RM 500 per month.
9.2 Usage above this amount indicates abnormal use and goes against our terms of use.
9.3 Guests will be charged for any amount above the aforementioned limit.
10. LIABILITY AND DAMAGES
10.1 The Guest agrees to hold the Company and the Property Owner harmless from any liability for personal injury or property damage sustained by the Guest or parties invited onto the Property by the Guest.
10.2 The Guest will be responsible for any damage caused to the Property beyond normal wear and tear during the Rental Period.
10.3 The Company is not responsible for any loss or damage to the Guest's personal belongings.
10.4 The Guest is advised to obtain appropriate travel and personal property insurance.
11. TERMINATION
11.1 The Company reserves the right to terminate the agreement and require the Guest to vacate the Property immediately if:
a) The Guest breaches any of these Terms and Conditions;
b) The Guest causes damage to the Property;
c) The Guest engages in illegal activities on the premises;
d) The Guest causes nuisance or disturbance to neighbors.
11.2 No refund will be provided in case of termination due to Guest's breach.
12. FORCE MAJEURE
12.1 The Company shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause that is beyond its reasonable control.
13. GOVERNING LAW
13.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.
13.2 Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Malaysia.
14. PRIVACY
14.1 The Company collects personal information to provide and improve its services.
14.2 The Guest's personal information will be handled in accordance with the Personal Data Protection Act 2010.
15. MISCELLANEOUS
15.1 The Company reserves the right to amend these Terms and Conditions at any time.
15.2 If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.
By signing the Booking Agreement, the Guest acknowledges having read, understood, and agreed to these Terms and Conditions.
